- E. Impact fee accounts. All impact fees collected under the provisions of this chapter shall be segregated and accounted for in separate impact fee accounts designated for the particular improvements in question. The impact fee accounts are as follows:
- (1) Road and Streetlights Impact Fee.
- (2) Recreation and Open Space Impact Fee.
- (3) Public Safety Impact Fee.
- (4) Route 25 Corridor Impact Fee.
- (5) Public Works Impact Fee
- • ● ● § 181-126. Public Works Impact Fee.
- A. Description of the improvement.
- (1) The Town is planning for a new municipal public works facility to keep up with the service demands of a growing residential population and new nonresidential development. This facility is required to provide services for a larger community with more passenger vehicle and commercial vehicle traffic as well as more people walking and cycling around town. This fee will be used to partially fund the new facility and for other capitals costs related to the need for additional staff to support the growing infrastructure maintenance and construction needs in Standish.
- B. Need for the improvement.
- (1) The Town's growing population is putting more pressure on the Town’s ability to maintain existing roads, sidewalks, and other public infrastructure. With more people living and working in the community, there is an expected increase in usage of these spaces, roads, and other facilities.
- C. Applicability.
- (1) This impact fee shall commence upon the earliest of XXXX XX, XXXX, or upon the Town of Standish’s commitment of funds to complete a new Public Works Facility. The impact fee shall apply to any development activity that adds new dwelling units, excepting Accessory Dwelling Units.
- (2) This fee shall apply to the construction of new dwelling units whether or not such unit is part of a subdivision. It shall apply to conversion or alteration of an existing building that creates or increases the number of dwelling units in a building. In the case of a development activity that increases the number of dwelling units in a building, the impact fee shall only apply to the new dwelling units.
- (3) New residential development, whether that occurs through subdivision development or land divisions exempted from subdivision review
- (4) Non-residential development subject to site plan review
- (5) Any expansion of an existing development that results in an increase in vehicular trips
- (6) Any change in use from one type of land use to another land use that results in an increase in traffic
- D. Exemptions.
- (1) The following development and construction is exempt from this impact fee:
- (a) Alterations or expansions of an existing building which do not result in the generation of additional vehicle trips.
- (b) Construction of accessory buildings or structures which do not generate additional vehicle trips.
- (c) The replacement of a building or structure destroyed by fire, flood, or natural disaster with a new building or structure of the same size or use which does not generate additional vehicle trips.
- (d) The relocation of a land use within the Town which does not generate additional trips.
- E. Impact Fee procedures
- (1) Any person who seeks a permit or approval for any development, activity or use described in Section C above is hereby required to pay the Public Works Facility Impact Fee in the manner and amount set forth in this section.
- (2) Preliminary determinations regarding whether a proposed development will generate new traffic will be made by the Planning Department in consultation with the Town’s consulting traffic engineer. Actual traffic generation, impacts, and the corresponding fee shall be determined in accordance with the procedures in Section F below.
- F. Calculation of the fee.
- (1) This impact fee is structured to be in proportion to the development project’s share of infrastructure costs necessitated by the development and as enabled by 30-A M.R.S.A §4354.
- (a) The need for additional capacity at the new Public Works Facility is directly related to the amount of new (primary) vehicular trips generated by new residential and non-residential development.
- (2) For projects that do not require subdivision or site plan approval, or as determined by the Planning Department as not requiring a traffic analysis.
- (a) The Planning Department shall determine the fee in accordance with the amounts in the table below, based on the most similar use to those listed below. Trips are shown for residential uses per dwelling unit, and for nonresidential uses per 1,000 square feet of floor area. Use Primary Trip Rate Each Dwelling Unit 1 General Office 2 Medical Office 3 Retail 32 Light Industrial 1 Bank 21
- (b) The applicant may request that the fee be calculated by either the Town’s consulting engineer, or by hiring a licensed professional engineer with significant experience in traffic engineering. The analysis shall be conducted in accordance with F(4) below. All costs incurred as a result of said analysis shall be the responsibility of the applicant. No permits shall be issued by the Code Enforcement Officer prior to the payment of any costs incurred by the Town’s consulting engineer.
- (3) For projects that require subdivision approval, site plan approval or as determined by the Planning Department as being required to conduct a traffic analysis:
- (a) A traffic analysis shall be conducted by a licensed professional engineer with significant experience in traffic engineering in order to determine the traffic impact, and requisite impact fee total, as measured by additional vehicle trips to be generated by a development project in the peak commuter hour (whether a.m. or p.m., whichever is greater).
- (b) The impact fee calculation for individual development projects shall use generally accepted standards, such as the Maine Department of Transportation's currently adopted edition of the Institute of Transportation Engineers Trip Generation Handbook or traffic generation data or estimates from field measurements or data collected at similar development types, and shall be based on the peak commuter hour of traffic in the a.m. or p.m., whichever is greater.
- (c) The costs assigned to trips shall be based upon a fee per new trip ("primary trip") to be generated by a development project within the peak commuter hour. Other types of traffic associated with a development project, such as the capture of trips passing a site ("pass-by trips") or trips in the area that are rerouted ("diverted trips"), shall not be utilized in the assessment.
- (4) The fee determination shall be based on the following formula
- (a) Public Works Facility Impact Fee = (Capital Equipment Costs) + (Facility Development Costs)/(2040 Projected Population) - (2020 Baseline Population) x (Average Household Size)
- (b) Facility Development Cost is $7,000,000, which represents the portion of the project attributable to future development out of a total project cost of
- (c) The 2020 population comes from the US Census, and the 2040 projected population is estimated from the Growth Rate calculated between the 2020 census and the 2024 American Community Survey.
- (d) The average household size of 2.64 is from the US Census American Community Survey, 2024.
- (e) Residential Impact Fee:
- • A single family residential dwelling unit generates one primary peak-hour trip per dwelling unit.
- • The Unadjusted fee per primary trip is $8,842.11. The Town will finance three quarters of the cost of improvements through the Impact Fee, and the fee per trip, therefore, shall be $2,210.53.
- • The amount of the impact fee charged to each residential unit is based on the Methodology for Developing a Public Works Impact Fee, dated X XX,XXXX. The Town Council has determined that the methodology referenced herein establishes a fee that is reasonably related to the portion or percentage of the infrastructure that is made necessary by the new development to which this fee applies.
- (f) Non-Residential Impact Fee:
- • The primary trip generation for non-residential development shall be as described in Section F(2) and F(3) above.
- • The Unadjusted fee per primary trip is $8,842.11. The Town will finance nine tenths of the cost of improvements through the Impact Fee, and the fee per trip, therefore, shall be $884.21.
- • The amount of the impact fee charged to each commercial project is based on the Methodology for Developing a Public Works Impact Fee, dated X XX,XXXX. The Town Council has determined that the methodology referenced herein establishes a fee that is reasonably related to the portion or percentage of the infrastructure that is made necessary by the new development to which this fee applies.
- G. Expenditure of funds. Fees will be collected on a Town-wide basis for the construction of a new public works facility that serves the entire community. 1 AMENDMENTS TO STANDISH TOWN CODE, CHAPTER 263, WEIGHT RESTRICTIONS (Additions are underlined; deletions are struck out.)
