[0:30] John Eddy King III: And you're recording? Perfect. Okay, thank you very much. Of course, good evening everyone. This is a meeting for the Board of Ethics. We are in City Hall, the Paul Bunyan Room, on June 3rd, 2026, and it's it's 5:30. Yeah, we're working from an agenda this evening, and we have to look at it to know that first up would be the introductions. There are no one, no one is zooming in tonight, so present members Mark Eastman, John King, Stephen Broe, James McGee, associate member Cody Silkener, guiding council Ed Gould, I'm member Shane London, and also the chair. First up, it's done. Next is the approval of the meeting minutes for April 16th that you have on the next page of our packet. If you've if you've seen them, great. If not, want to take a look, just make sure they're in order before we vote to accept or maybe vote to change. Does it seem meaning? That's the motion by Cody. Is there a second by John? We everything present, we just do a vote here. Yes. John? Yes. Stephen, if you're ready? Yes. James? [2:14] Stephen Brough: Yes. Yes. And that's two. According
New Business
[2:22] John Eddy King III: to the agenda, the new business that we have is the request for an advisory opinion on the City Council's referral, also known as CO26152, Councillor Mallers, 3-31-26 remarks captured in the live mic in the first meeting. We have next in your packets before we get too far, if I haven't messed up the order of my packets, the code of ethics and our procedural rules are on top, and then there's something I should give to everyone if they don't have it already. What's next is hypo, it's just a mistaken packet. You're your the packet that you should have is three pages, and if the third page should say three and four, obviously we'll say three and four. The second page should have one and two at the bottom of it. If that doesn't look like your packet, tell me and I'll give you the correct one to have. Either one you got, you might you might not have the right piece. If you don't, it's not it's not your fault, it was just a mix-up in the printing of things. It's the top of it, that's the top page, City of Bangor order. Oh, the very first page, the City Council action. Okay, well no, it's not the action that I would have three pages. Yep, it's three pages stapled, I believe. Yeah, it's a state with you government. So we get you the right ones with it is indeed [4:07] Speaker C (unidentified): three pages. These are not. [4:11] Stephen Brough: Yeah. Okay. [4:13] John Eddy King III: Easy. Yep. Sorry about that, guys. Steven, your last one. Let me take a look [4:20] Speaker C (unidentified): No numbering on the bottom of the creditors' pages. [4:27] John Eddy King III: You all once had 34, but this one missed all of this, so they didn't have the number two. Ah-ha. Group. You guys just got the correct one? I think you dropped this one off. No, that's okay, because this one's incorrect. Correct. Got it, that's right. Please disregard the incorrect one. So, we'll have a selection of pages here that will, actually all the pages at this point are to help us with the city council's referral. However they are in order,, you can mix and match, of course, as you like. The important part is the City Council action in the order, which describes the things that the City Council is asking us to consider and investigate, like we have been doing. Unless we vote on it, there really is no change to what we've been doing and what we're about to do. We're going to want to look at the information that we have through the Council orders and actions have a discussion about whether or not there's anything additional that we would like to see as a board to help us investigate the matter and if so make records of it and then we're going to try to schedule a time to meet and go through those materials together if you wanted to take a and look through them the time the first step of this of course is the discussion regarding whether we want more Excuse me, whether we request voluntary statements from any persons involved and the floor is now open for any discussion regarding this initial stuff. Yeah. [Speaker C (unidentified): Anybody at all?] But we're only on A, Section 3A, so if there's anybody you'd like to hear from voluntarily, like we've done in the past, ask for statements, and of course they can give it to us. [7:38] Speaker C (unidentified): I'm actually surprised he's not here. [7:45] Speaker D (unidentified): About yeah, so I'm not sure how he can be here when there's a council meeting that he's on, so not to be that very bad news, but you can't be in two places at once. [7:58] John Eddy King III: No, and this is just the first of our procedures to that point is there anybody else anyone could think of that they'd like to hear from or at least invite a voluntary statement from in the council order we can ask for a voluntary statement from any person I [8:26] Stephen Brough: Was thinking maybe in regards to the response article that was a little medium. [8:39] John Eddy King III: So the person who wrote that article for article which there was well I don't know how many of articles there might have been one in mind it was the first response that he had. Okay. [8:51] Stephen Brough: I have to look back at the things that the articles you just get like a clarification of like you know what was discussed. Yeah. [9:06] John Eddy King III: even it looked like you might not it looked like [9:10] Speaker C (unidentified): you were about to say something but well i actually heard that one live but the next the next day yeah and I think we've all had a chance audio relatively clear what was said good catch on the EDM reporter I have not seen that Arctic that response yet that was during the time period where I was traveling but that's again I remember that you were yeah we're all over the place right yeah i just got done with that three weeks ago yeah is [10:06] John Eddy King III: there is there anyone i'm asking suggesting is there anyone like maybe someone from the school board is that worth hearing from anyone maybe they perhaps the chair from the school board the chair from school where they actually have a vice chair too i think i'm not sure i don't think it's they're a bigger thing do you remember if there's a there's a chair just here but is there also a vice of the vice chair of the school if it's if it's worth asking for that as well or if that's not needed i mean maybe [10:55] Stephen Brough: i was just gonna say yeah [11:03] John Eddy King III: yeah easy enough yeah john before we move on and we come on this for sure but just want to make sure checking around the room if anyone else has anyone they would like to request a voluntary statement from about the issue obviously yeah definitely yeah anybody [11:37] Speaker D (unidentified): else there's a procedural question if i can ask there's [11:49] John Eddy King III: no public comment so really i don't think so but i don't want to be wrong so it's it's not over here so there's no opportunity me for my public input at this point yeah so i would i would say no thank you and it wasn't [12:04] Speaker D (unidentified): input it was what you guys are deciding on i guess my you can't speak in this movie but you're here [12:11] John Eddy King III: as a witness and as a participant only in the sonic way but it can't be any more popular thank you moving on from that then the next is the discussion whether or not the board desires is to review any other records on the bottom of the city or any other public agencies like several of you already said the meeting the question was recorded and recorded on if there is anything else we would like to request we certainly can so the floor is open for that the floor is open for all of these i don't know if they keep saying that but is there anything else anyone would like to take a look at change [12:55] Stephen Brough: or what i'd say besides a reporter just the article yeah okay you're [13:25] John Eddy King III: Just saying what you could think of anything more marketing, yeah, you can hear no ideas on that pretty clearly. Okay, steps in the discussion of any pre-hearing issues or concerns that we might have. Anybody here worried or concerned, worried that's not the right word, excuse me, does anybody here or have an issue or concern regarding work we're about to do? That's the one I always like to check in with you and make sure we're, we're proceeding forward the way as it should be. Yes, there's nothing that you would have as a red flag or a book to come up, but that was one touch. Okay, well if you had a concern or an issue, I don't [14:41] Speaker E (unidentified): know if it's relevant or not, but I would like it for, would you have our public meeting, yeah, that anybody working for the city or the county or anything like that make sure that they make themselves aware that they are not speaking with the happen wherever they're working for, yeah. [15:28] John Eddy King III: So in other words, if there are any witnesses of the public hearing that are public officials, ask them to identify in what capacity they're speaking, yeah. Okay, would we extend that to everyone that work that draws paycheck from the city, yeah, because they're all covered by that provision of the ordinance, let's sort of sweep around just in case. [Stephen Brough: Okay, term] determining, excuse me, the determination of a date for our second meeting, and that would it would be a public hearing area then. Legal has given a list of dates that are the first crack at some of these, okay, just to see if we could potentially have a quorum and which is for their digital calendar, it could be the first, oh I see, okay, there these are sort of back-to-back days, the first opportunity that we would have to get either this room or the room that we're used to being in would be June 17th or June 18th. Actually, I have both states. There are both of those states. [Stephen Brough: Okay. Yeah, that's] right. So it's three, four, there's one associate member or five regular members. is yeah so it's pretty good but yes yeah so Stephen do you and again there were these aren't the only this is not the first this is just the first swing date 16 17 I am available [17:39] Speaker C (unidentified): considering that we are and you said this would be for the regular it would be I don't know [17:46] John Eddy King III: For sure that this we might need in here again. I don't know, usually Mary tries to get us in the council chambers, and there are six dates available. I maybe instead of breaking them down like this, I should just say them all out loud and make people backwards if I say them too fast. The 17th and the 18th, which are Wednesday and Thursday of June, the 29th and the 30th are available, which are Monday and Tuesday, also July 1st and July 2nd, which are Wednesday and Thursday as [18:27] Stephen Brough: of [18:30] Speaker C (unidentified): now I have nothing on any of those dates so I can be flexible. Obviously the other concern would be to make sure that we're not as we are tonight on the same night as [18:44] John Eddy King III: that was okay. I'm not sure how that would actually work because we would be a public hearing and we would need to be right live, so I don't think that they could from what I under that's a good of course it's a good question Stephen a good state excuse me as I understand that it wouldn't be the same night as any other meeting because of the public hearing quantity we'll look at the city calendar to make sure. Yeah, so I mean I'm almost positive that we would be in council chambers as well we can just ask Mary to make sure there's a the 17th there's a budget workshop and maybe that's in here council chambers council chambers okay so and again this list from Mary was given to me just a couple days ago of course you know slots are taken so it sounds like maybe the 17th is not going to work right John that's what you just told me was the 17th that has the workshop there and that would make sense right like yeah this is not she didn't block off these six dates there was no reason to believe yeah we wouldn't hold them that way okay does the 29th and the 30th well I mean we can we can rule out the 17th we can expect to rule out the 17th it sounds like that one's gone. I guess the 18th, no one commented on either way. No, I'm sorry, I knew you said you couldn't do the 17th or the 18th. [20:15] Stephen Brough: Right, I'm out the 20th as well, but I couldn't make the 30th. Okay. Okay. Where do we go? [20:25] John Eddy King III: 9? Do you have a reference mark? Is everything... [20:33] Stephen Brough: As long as it's the same time. [20:35] Speaker C (unidentified): Okay. None of those dates matter. [20:37] John Eddy King III: out okay and it will be your own it I can't see any reason why it wouldn't be 5 30. Yeah, I've got a deposition on the 29th, one o'clock, could run late. Okay, deposition, so that would be two of us are not available for the 29. And it's not to put a lot of pressure on him, we can't go without you. All right, yeah, nothing, but there's your other guy, you know, it's okay if everybody else is sort of basically not you in the meeting, and it's nice to be involved. Yeah, right, I mean, look, let's just pay homage here, but we, I don't believe anyone from the solicitor's office can fill in for you, no. That's why, that's why, so yeah, I maybe I should have sent this to you first. No problem. Okay. 30th is okay. Yeah. Steven, what do you think about the 30th? [21:33] Speaker C (unidentified): I'm good with it. Assume 530. Yeah. James? [21:37] John Eddy King III: 30th work? 30th is good. Yeah? Yeah. Cody already said yeah. [21:42] Stephen Brough: What about you? 30th is fine. All those other dates won't count. Okay. [21:47] John Eddy King III: If we had to, because I'd like to give Mary, just in case my messenger, which would be the 30th, is gone. And [22:01] Stephen Brough: that doesn't work. Okay. Koji. Koji, are you on [22:09] John Eddy King III: first of those four days available? 17th gone, 18th and 29th you're gone. Your deposition at 1, Ed, on Wednesday the 29th? I'm sorry? Monday the 29th. Monday the 29th, thank you. On Monday the 29th. Well it depends and there are multiple parties, so I mean if it was, if it was just me taking the deposition, you've done by five, but there are a number of other attorneys, so let's just assume, let's assume that day's not going to the 29th. Yeah, I mean, I just couldn't guarantee that, right, and I don't want to waste the board's time, I don't want to rush you, like if it, if it just got ugly, you know, for time, it doesn't make sense when we have other options, so June 30th is the first opportunity we're going to try. For the sake of a backup, can anyone do July 1st and July 2nd as a second chance? I know that you cannot either. Hypothetically at 5:30 p.m., how, Mark said he could. John, first and second work at all for you? Yeah, that's fine. Okay, Stephen, I am good with either day as of now. Okay, and James, hypothetically, June, July 1st or 2nd might work for you as well? Okay, again, those are, those are, yeah, okay, this first, I'm going to try the 30th as our [23:58] Speaker C (unidentified): first priority even though [24:06] John Eddy King III: We have proceeded past parts A, B, and C, which are asking for voluntary statements from anybody, asking for any additional records, and if anybody had any pre-hearing issues or concerns. I'm going to just give one more crack before we stop talking about that and move on to other business. Has anyone thought of anything they wish they had put in before we proceed? Here's a question. Do we need to vote on who we're requesting voluntary statements from in this meeting? I don't think we have to vote, I mean we can discuss it openly and certainly if there's something that you think is a good or a bad idea, you know, pros or cons, like, I mean, is it a request? It's not a formal action by the board, so okay, so it's just a discussion, right. Okay. That's it. Okay. I was just curious. Yeah. Okay. Anything further from anyone? We pretty much got what we, have what we need, we know where to get it and. Okay. Then, moving on. Is there any other business before the board? See, we have a term. We shut this down to something. We only recorded the one with one setting.
