[0:27] Chair: This meeting will come to order. This is the October 10th, 2026 meeting of the York Board of Appeals. Tonight I'll go through the members present. We have, we have Ken Churchill on the end. Next to Ken is John Campbell. John is an alternate and he will serve tonight as a regular member as Matt Lovo is not here. And then on my, on my right, we have Bruce Landay, alternate. Mitch Picard is a regular member. Michelle Marianne, regular member. And myself, Paul Salicane, Chair. I would also note tonight, starting tonight, we have a different recording secretary. She works remote. That's Patience Horton. She works with many boards in town and has accepted to work with the Board of Appeals. So she will be recording. Aside from the video, she records our meeting. So, tonight, just to go through our agenda, I'm going to take the items on the agenda a bit out of order. This is our first meeting in October, which, according to our bylaws, is our organizational meeting. So we need to elect officers for the year going forward. The positions that are chosen, I guess, or voted on, are chair, vice chair, and we have not had, we've had our secretary position vacant for a while. And we will try to name a secretary as well tonight. So before, as to get started, I mean we're gonna get jump right into our nomination process here. So for those positions, now just one clarification, the voting is only by regular members, and in this case, John Campbell is acting as a regular member. I will call for nominations. Members can nominate themselves, and nominations don't require a second. So I would call for nominations for chair. Are there any nominations for chair? Chair, please just indicate that you want to make a nomination and I will call on you. Oh yes, Michelle. Okay, that's the first nomination. Michelle Marion is nominating Paul Sallocane, myself, as chair, for the position of chair. Are there any other nominations? Are there any other nominations? Hearing none, by, I'll say unanimous consent, Paul Selicane is named chair for the year going forward. Moving on to vice chair. Can I have nominations for vice chair, please?
[4:28] John Campbell: Do we vote on your?
[4:31] Chair: No, there's no vote. Okay. Because nobody else was nominated. Okay. Unanimous consent. Okay. Sorry, I didn't mention that. But it's in Robert's rules, so you can check. I nominate Rob. I can't nominate him. He's an alternate now.
[4:51] Ken Churchill: Sorry. Oh, he's an alternate now. Oh, God.
[4:55] Chair: So you're just there. Michelle. Okay. Ken nominates Michelle Marion for vice chair. Are there any other nominations? Are there any other nominations? Hearing none, I'll close that portion. And as I did before, I would indicate that Michelle Marion is selected as vice chair. We don't need to vote. It's by the unanimous consent. Okay, moving on to the last position, secretary. Now, I had, for the sake of the public, I had reminded all the board members what the duties of the secretary are on the Board of Appeals, because we hadn't had one for a while, so it was safe to remind people what the position does. Does so moving on to that, I would accept nominations for secretary. Are there any nominations? Yes, you can. Are there any nominations? And I would just note in the case when no one, no one is nominated. It can be taken up later, I guess, by the select board that they would name someone as the secretary. But are there any nominations? Okay. Hearing none, we'll move on. We won't be filling that position tonight, and we'll work in the future to fill that position. So, moving on to the next item on our agenda, that's the approval of minutes for our meeting from Wednesday, August 26th. And so, as a reminder, at that meeting, we had, well, tonight we have the minutes from the meeting and two findings of fact to approve the, matters of that evening were Ernest Del Don, six Norwood Farms Road, Unit C, and that was a minor dimensional variance and we approve that, and then the other item was an administrative appeal brought by Michael Kazuk, 49 Main Street, regarding a failure to deny permit, 2-2 character, base codes, CD4 encroachments, storm drain runoff, and sewage, public safety, and no off-street parking. The property in question is 51 Main Street, York, Maine. Map 23, lot 120. So I first would start with the minutes. Are there any changes or modifications from the minutes?
[8:43] John Campbell: That's yes, John. I will not be able to vote because I wasn't at that meeting. That's correct.
[8:47] Chair: Okay. So you can just abstain, but are there any changes? Yes.
[8:54] Ken Churchill: Excuse me. Last paragraph on page one, 49 Main Street is M-A-I-N.
[9:03] Chair: Oh, that's right. Okay. It's not the state, it's the main. Okay.
[9:08] Ken Churchill: Okay. On page two, thirds of the way down, the board discussion. I think Mr. Kazook's name is missed.
[9:20] Chair: Okay, and Bruce had notified me of that and I made a note on my copy, so yes, thank you. Oh, and then also there was a typo on the third page, minor differential variance, second paragraph. It says stands and it's supposed to be standards, so we'll modify, make those changes. And I have a motion to accept these minutes as amended. Make a motion that we approve the minutes as amended. Second. Can second that. All in favor, just give me a hand vote. Okay, thank you. Can vote too. Oh, you abstain, sorry. All right, so that's the minutes. So on the, I'll take the del don minor dimensional variants, so in that case there are three documents that we have for that, the actual findings of the fact, the official record, which is basically a document that accounts for all the information about that variance, and then a certificate of Board of Appeals, which is actually signed and notarized by the town and recorded with the Registry of Deeds. So of these three documents, are there any changes, modifications? Okay. So I would entertain a motion to accept these three documents as correct.
[11:08] Ken Churchill: Make a motion that we approve the documents as written.
[11:11] Chair: Okay. Ten seconds of that. Then all in favor? Okay. Thank you. All right. So that's our busy work on from our last meeting, so moving on, so our matters tonight under consideration, we have a administrator. Yes, first matter is crystal turner 49 eureka avenue requests administrative appeal grandfathered buildable lot variants and state of maine tep order. I'm not going to read the number. The property in question is 40 Eureka Avenue, York, Maine, map 45, lot 10. So on that matter, I think we'll first hear from the appellant. Is Crystal here? Crystal, if you would come up to the podium and introduce yourself, please.
[12:19] John Campbell: Not to interrupt you, Mr. Chair,
[12:20] Chair: but just a correction on the matter of consideration.
[12:22] Ken Churchill: There was a typo of 49 Eureka, it's supposed to be 40, so oh it's supposed to
[12:26] Chair: be 40 yeah that's the very top of the documents yes just the agenda okay thank
[12:34] John Campbell: you yes crystal so just please oh I see yes we'll correct it on our
[12:49] Chair: on our documents. She should probably talk into the microphone. Yeah, just pull it over to you. No,, there you go. All right, thank you.
[13:04] John Campbell: I wanted to put a shed, a small shed for beekeeping and just general maintenance on our property. We've run out of space in our house and we need the place to put my husband's, a beekeeper, and he has been for a while. I can read you what I have here first in the pack there's a plot map locating our house with the correct 15 foot setback on the right-hand side.
