[7:22] County Commissioner Association President (visiting official): Clark. We should develop. Thank you for giving me an opportunity to come before you again. I made a commitment last year as president that I would come and visit each county at least once during the year. It's going to be an opportunity to engage with my colleagues and learn a little bit about what's going on the state level. We were able this last year working with a number of commissioners and administrators to make our case before the legislature on the importance of increased funding for jails. Historically some of you may remember if you might have served in the office of sheriff that this state thought that it would be more efficient in running the jails on the state level. They quickly learned that local control is a much more effective way to meet the needs of our communities and our counties, and they turned the jails back over for operational purposes. They left in place some legislation that affected how much we were able to raise for the jail budget on the property tax, the jail cap. They also committed to a certain percentage of funding, recognizing the jails are part of our justice system that was in 2021 adjusted to about 20.4 million dollars. It has remained static since that time with supplemental money coming from the state on occasions. But the last four or five years we have had flat funding. That has put tremendous pressure on a lot of the jails, particularly those like ours in Penobscot that are seeing an abundance of inmates in those costs that you can understand, as you deal with it, have risen as wages and other associated costs of operations. It's put an inordinate amount of pressure on those counties that can't budget for their jail to run what the property tax cap allows you to raise. So several counties have had to dip into their reserve funds and their fund balances in order to cover those operations. We made the case and were able to get $4 million in supplemental funding in the first year of session, then they added another 4Million at the end of last session, the supplemental, which got us to about 28.4Million funding. That was only one time money, though there was legislation that passed the criminal justice and public safety committee. To increase that about the state share would be 230Million dollars. And to remove or reduce the amount that you have to. Spend on community corrections which was a difficulty for some counties to have that obligation although it's important to see what we can do to keep people from being in a jail cell some dealers just don't don't have the need for that and it kind of hands right and finally putting a cost of living adjustment is critical because costs as we know right we are hopeful that we will be able to get that legislation through the committee passed it almost unanimously it fell apart at the Appropriations level we've met with the speaker we've met with the chair who put that legislation in for us they're willing to bring that forward again and with the help of the number of folks I think we can continue to make our case we're optimistic that with a new administration maybe they will reflect better on the role that counties can play in helping our municipal government partners one of the areas that we are talking about is how we can collaborate more with municipal government on Things such as public safety code enforcement assessing animal control the key issues that we're mandated to provide that we are not able to provide if we can't find the people to do it if you look at many communities they have partnered up to have a code enforcement officer that serves several communities I know some counties are doing animal control Cumberland the last few years has provided assessing services which has helped those municipalities that have been able to have a full-time Assessor so there are areas that we want to continue to work with main municipal and our municipal partners on you may have read about what we did. I think I mentioned it last year up in the Holland area to help them form a fire EMS district that serves eight communities and two townships. So there are ways forward that can be positive, and we look to continue to work on that. We have a group looking at Title 30A. The sheriffs had some legislation that they wanted to propose last year. We felt it was effective for us to be sitting down beforehand and working. So there are three sheriffs, three administrators, and three commissioners who have formed a working group to look at aspects of Title 30A that may need to be updated or revised, particularly for those counties that have gone the route of the charter. There are some things that can put there. Finally, we just came off another successful convention. Mention redevelop and your manager went, I certainly hope they had a productive time, and we'll give you some of the news of what happened there. But our goal is to continue providing these opportunities, and we're discussing at the board level. The idea of having an executive director, again, we've contracted for lobbying the last 4 years. They find a job for us, but we really need. To look at what counties have for resources and to look at what we can do to advocate more strongly for counties. I think that good record could take some of those lobbying responsibilities, but more importantly could start to develop materials that could be helpful, templates of policies, contracts, developing orientation materials. The days are coming where we're not going to see people as dedicated as some of those you recognize today who will stay with you for decades, and we need to be prepared. To help our new commissioners and to help our new staff to understand things. So with that, I thank you for the time to come. I would be happy to answer any questions that you might have, and certainly look forward to continue to work with Commissioner or develop, if he's so inclined, to represent you in the future.
[14:13] Chair/Presiding Commissioner: from my personal point of view andrey three things first of all i really wish the mcca would pursue potential legislation to make it optional it's not mandatory an option of the counties to have a an appointed treasurer as opposed to an elected treasurer seven years ago i tried to help mcca with proposed legislation TO DO THAT AND WHAT NOT, I THINK THE EASIEST WAY IS FOR THOSE THAT WOULD LIKE TO CONTINUE TO HAVE THEIR TREASURER ELECTED, BUT FOR THOSE WHO WOULD LIKE TO EMPLOY THEM, WE'RE NOT THE Only county that's had bad situations elected. So I would like to see them pursue something that would help that. The second one, by the time the election is, I would like to see them work towards making the office of sheriff now pass. I really think that would, I think first of all it would help attract good qualified candidates, and it would get the politics out of it, and so they can focus on the true, you know, I'm gonna tell you that we have people around the state and whatnot running for sheriff who wouldn't even get an interview. You know, we need to have as good of people running the sheriff's department as Miss Valley's has running them. Yes. The last one is, I really wish we could get some kind of statewide legislation to help counties form regional ambulance services. We're losing ambulance service in rural areas of Maine, and I think we as counties and whatnot I'll take the lead on that. We could just get some help from the state with funding and organization. For my personal, that's my personal wish list.
[16:02] County Commissioner Association President (visiting official): You as you will be probably not surprised. You're not the only one who's brought these issues up, and particularly the, 1st, 1, the option of allowing for appointed on a county basis is 1 of the areas that is under discussion. I don't see that we will necessarily bring that forward for this 1st year of the legislature, because we need to see what the new administration and legislature are going to be comprised of. But we are having discussions about a number of positions at the county level and how best proceed with those. The goal is to make sure we have people who are qualified and willing to serve the citizens that we all.
[16:43] Chair/Presiding Commissioner: I'll have a responsibility to take care of, but I understand it correctly though. If you don't bring it in the 1st section, it's going to be determined to be residency for the 2nd that is correct bill.
[16:54] County Commissioner Association President (visiting official): But there are cases that can be made and we've, we've had discussions with the legislature about the jail standards council. They are empowered to bring legislation in at any point that they feel necessary. So, option two, that you would suggest that if is not tried forward this year could be brought forward to the EMS. That is something right now that there was a revision last year. It's representative for debt from Newport brought forward a bill to allow EMS as well as fire. Fire can organize regionally now. But EMS was added to that bill that he brought forward. So there's an opportunity there. And we've reached out and had some good discussions with the MA leadership about a joint group of not only county and municipal officials, but bringing in the regional districts like water and sewer, school management, to talk about what the state mandates that they don't support financially, and see if we can come up with a proposal that causes the state to reflect more closely on the things they passed that put a burden on us that they don't take care of. So the EMS is probably the easiest one, because most of those folks, as you know, are committed to helping each other when there's a need, but mutual aid needs to be bilateral, not one way. And that was a challenge that some of these smaller towns were having, is even though they wanted to help, many of their employees or volunteers were 45 minutes or an hour away from fire station during the day, so they couldn't always respond. So forming these regional groups with a full-time chief for administration has helped to organize and make sure that they're not having to buy The 750 million dollar fire truck to sit in the garage if they can work with the next door. So there's there's things underway, and we hope to continue communication with our counties of best practices that are going on elsewhere. You're kind of fire administrator a year ago. That's going well, because they're helping to support those local fire departments that are volunteer that still need some, help. There's a lot more, you understand this, there's a lot more complications that volunteers have to comply with these days, and you 've driven off a lot of good people who just either can't put the time in or have taken a job with the full-time department and now can't do the volunteer service

[19:56] County Commissioner Association President (visiting official): Right now, we've not addressed, but the jail standards council has been working more closely with the Department of corrections personnel. We've had very good luck in. Updating what the requirements are, and they've been more responsive to us in terms of removing the cap. That's on the agenda, but the first step is making the state recognize that jails provide an incredibly important resource in the criminal justice system. And most of what we have in our jails now are pretrial people, because there are some complications with the courts and the mental health system in addressing that. So step one is to get the state to get back to a 20% funding model, which was historically but they originally did it was not memorialized in statute but there was an understanding that the state should have a good role in funding the jails so if we can get to that level I don't know if you saw what you saw for your a lot of addition but the other thing that bill will probably understand it overseeing those is moving back a year as to when you provide that funding, kind of like the school schools get paid based on their population for 2 years ago. It's challenging now for those counties that are still on a calendar, your budget. To know what their revenue is going to be. So you're estimating. And several counties have found that because of the, change in population. They're actually budgeting for more revenue than getting from the state, and that creates complications in your budget process. So we are looking at addressing that in the language, too, but we've not bitten off that big achievement piece of the pie yet. If we go there, I think we're going to run into the problems with even main municipal that you are affecting the property tax payer with other solutions.

They also were dealing with six separate medical calls that we're trying to coordinate the resources for of animal services that we don't have any control over, so it's very frustrating down there. People need an ambulance, they're talking about wait, and we're rerouting services that we don't dispatch SPOTS FOR TO COVER THE DIVERSITY SO THEY'RE NOT PRETTY MUCH SLOWING DOWN JUST A LITTLE BIT.

And I was only providing with the actual mileage on the vehicle at one point in time for the DA's office so we didn't have a record to match that up as to how many miles those so I assume we'll take care of that next year when that goes through but it wasn't the intentional slight. I just want to make sure that the admissions and public was aware of that was the reason beyond well the more miles we drive without an incident adds to the success. Yeah the success flip side that obviously less accidents too but yes the more mileage the better the calculations. Next item I had a request well we had a request for copies of the reports as a four-year requests of the monthly reports that the department has provided and we're addressing that request anyway but I would like to see whether the commissioners want us to start looking at the website working with our provider to see if do you want us to start putting some of that stuff on the website under the commissioner's item meeting so You're reading the meeting material, so these, whether it be department reports, other items, we have the minutes and agendas right now, but we currently don't provide that information. Last one, just to mention, I think I've caught two of you already, but Friday, I'll be leaving and I'll be on out for next week anyway, but I will be back on Monday. Staff that's aware of it. And those that need to cover certain things, we'll be here, and I guess that's a good lead into the BAC meeting reminder. The 1st BAC meeting is this Wednesday night at 6 PM right here at the commissioners meeting room. Right now, I've structured it since I usually do keep Wednesdays at 6 as they've been done for years. We only have one new member who I provided, along with Monica's help yesterday, to provide an orientation session with, and she doesn't fare and we have a problem on Wednesdays. I'm assuming those are going to stay as well as we have those scheduled for the next three weeks and a potential fourth week for the last of October, and we can take that additional week. So two out of three of the offices didn't yield. So we had one that was a repeat. So they weren't new. So Kathleen basically ran again or accepted it again. Yeah, I see what you're saying, so that's obviously we didn't meet with her. Yeah, but yeah, there was one district, I suppose I should say, you know, honestly there was one

[42:48] Speaker C (unidentified): had someone ask me about Columbus Day and how it's marked on the calendar, where the state, I think, has recognized it as Indigenous People's Day. Yeah, we do too. Yeah, but on the calendar, what's happening on the county captain, it says Indigenous People, that's, that's what he was remarking. Yeah, where the state recognizes Indigenous People today, and so do we, yes, also recognizing Columbus Day, which is kind of, I guess, is controversial.
[43:27] Chair/Presiding Commissioner: I don't know, that's what's up, the rationale behind that, and that I did explain this to commission develop before, but the president actually did an executive order last year on a federal level restoring Columbus State, so the feds, as I understand it at the moment, still consider that to be Columbus Day, and state considers it so. We're not taking a position one way or the other, call it whatever you want, that's not the point. It's just that we're, it's another one of these situations where you have two different levels of government and we're in between them, and so the state doesn't, I mean, the federal government doesn't recognize that, I mean, I don't know if they recognize that or not, but I know last year President Trump asked the executive order that determined that to be common state is based on that, whether or not that carries forward to this year I haven't kept up with that to see if he is executive order from last year just continuous or not, but the rationale that's why it was the case and it's no reflection on our position whatsoever. If we didn't put Columbus State, we'd be getting complaints, or not us, you would be getting complaints from the other side saying, that, you know, the federal government recognizes us. I mean, not. And we're not taking a political position here 1 way or the other. That's why it's listed with both, call it what you want, I guess. But obviously, if you want us to haul it down, we can do that.
